User Agreement

1. General provisions
This User Agreement (the “Agreement”) is concluded between you and Talents and sets out the practical rules of using the marketplace: how accounts, profiles, contracts, and payments work. It supplements the Terms of Service and the Privacy Policy — by registering an account or using the platform you accept all three.
Where this Agreement and the Terms of Service overlap, the Terms of Service prevail on questions of liability and disclaimers; this Agreement governs the day-to-day use of the service.
2. Account and registration
You may register one account — with an email address, a Telegram, Google, or GitHub account, or a TON wallet. The information you provide must be accurate and kept up to date.
You are responsible for everything that happens under your account. Keep your credentials, connected accounts, and wallet recovery phrases safe — we are non-custodial and can never recover a wallet for you.
3. One account — one wallet
An account is bound to exactly one TON wallet. The linked wallet is the wallet that signs escrow payments, receives payouts, and confirms every on-chain action. Connecting a different wallet in the interface does not relink it: to change your wallet, first unlink the current one in Settings, then link the new one.
Never link a wallet you do not fully control. Every on-chain action signed by your linked wallet is considered your action.
4. Two roles: Client and Talent
One account can hold two profiles: a Client profile for posting jobs and hiring, and a Talent profile for offering services and getting hired. You can create either or both and switch between them at any time.
Each profile must describe you truthfully — real skills, real experience, real portfolio. Misleading profiles may be restricted or suspended.
5. How work is arranged
Clients publish job posts; talents respond with proposals; scope, budget, and milestones are negotiated in chat. When a client publishes a project or sends an offer and funds the escrow smart contract, a contract is formed directly between the client and the talent.
The talent undertakes to deliver the agreed work; the client undertakes to review it and release milestones without unreasonable delay. Talents provides the venue and the tools but is not a party to that contract — see the Terms of Service.
6. Payments, escrow, and fees
Payments run through non-custodial escrow smart contracts on TON. The client funds the escrow when publishing a project or agreeing on a milestone; funds are released to the talent when the client confirms the work or per the dispute-resolution outcome.
The applicable service fee is always displayed before you pay. On-chain transactions are final — double-check amounts, currencies, and addresses before signing, because confirmed transactions cannot be reversed.
7. Premium, boosts, and NFT
Talents offers optional paid features: the Premium subscription (raised limits and access to premium-only projects), per-item boosts (a boosted project or proposal is placed above regular ones for the stated period and gets a highlighted card), and the Genesis NFT (premium for as long as you hold it).
Paid features are digital services activated immediately; unless the law requires otherwise, these payments are non-refundable. A boost changes placement only — it does not guarantee views, replies, invitations, or hiring.
8. User conduct
When using the marketplace you agree to:
- communicate respectfully — no harassment, spam, or scam attempts;
- submit only work you have the right to submit, and post only jobs you intend to fund;
- not use the platform to launder money, evade sanctions, or finance illegal activity;
- not manipulate reviews, statistics, referrals, or placement mechanics;
- not solicit or accept payment outside escrow for contracts formed on the platform.
9. Content and intellectual property
You retain the rights to the content you upload — profiles, portfolios, job posts, attachments — and grant Talents a non-exclusive license to display it for the purpose of operating the marketplace.
Unless the client and the talent agree otherwise, intellectual property rights to the deliverables pass to the client upon full payment of the agreed amount, and the talent may show the delivered work in their portfolio.
10. Referral program
You can invite new users with your referral code and receive rewards from the activity of your referrals, as described on the referral page. Self-referrals, fake accounts, and misleading promotion are prohibited and forfeit the rewards.
11. Suspension and termination
You may stop using Talents at any time: unlink your wallet and contact support to delete the account. We may restrict or suspend accounts that violate this Agreement or the Terms of Service. Escrows that are already funded continue to follow their on-chain rules regardless of account status.
12. Changes to this Agreement
We may update this Agreement as the product evolves. The current version is always published on this page and takes effect upon publication. Continued use of the platform after changes means you accept them.
